1. Acceptance of Terms

By accessing or using the NurseWear website (the "Site") or purchasing any product from NurseWear, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or place an order. These Terms apply to all visitors, customers, and users of the Site.

2. About NurseWear

NurseWear is an online retail store offering graphic apparel and merchandise designed for nurses and healthcare professionals. Products are fulfilled on a print-on-demand basis through third-party production partners. NurseWear operates as an independent brand and is not affiliated with any hospital, healthcare institution, or nursing organization.

3. Eligibility

You must be at least 18 years of age to place an order on this Site. By using the Site you represent and warrant that you meet this requirement. NurseWear reserves the right to refuse service to anyone for any reason at any time.

4. Products & Print-On-Demand

All NurseWear products are produced on a print-on-demand basis. This means each item is created specifically for you at the time of your order. As a result:

Product colors may vary slightly from what is displayed on your screen due to monitor settings and print production variables

All sales of personalized and print-on-demand items are final unless the item arrives defective, damaged, or incorrect
NurseWear reserves the right to discontinue any product or design at any time without notice

5. Pricing & Payment

All prices listed on the Site are in U.S. dollars. NurseWear reserves the right to change prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.

We accept all major credit cards and other payment methods available at checkout. By submitting an order you represent that you are authorized to use the payment method provided. NurseWear is not responsible for any fees or charges imposed by your bank or payment provider.

6. Orders & Order Confirmation

Placing an order constitutes an offer to purchase. NurseWear reserves the right to refuse or cancel any order for any reason, including but not limited to:

Product availability issues
Errors in product or pricing information
Suspected fraudulent or unauthorized transactions

You will receive an email confirmation when your order is placed. This confirmation does not guarantee acceptance of your order. NurseWear will notify you if your order is cancelled and issue a full refund where applicable.

7. Shipping & Delivery

Shipping times consist of a production period plus a transit period. Estimated delivery windows are provided at checkout but are not guaranteed. NurseWear is not responsible for delays caused by shipping carriers, weather events, customs processing, or any other circumstances outside our control.

NurseWear ships to addresses within the United States and select international destinations. You are responsible for providing a complete and accurate shipping address. NurseWear is not liable for orders shipped to an incorrect address provided by the customer and no refund or replacement will be issued in such cases.

8. Intellectual Property

All content on this Site including but not limited to graphics, designs, logos, text, images, and product artwork is the exclusive property of NurseWear or its licensed designers and is protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, distribute, modify, or use any NurseWear content for commercial or personal purposes without prior written permission from NurseWear. Unauthorized use of NurseWear intellectual property may result in legal action.

9. Acceptable Use

By using this Site you agree not to:

Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
Attempt to gain unauthorized access to any part of the Site or its systems
Use automated tools, bots, or scrapers to collect data from the Site
Submit false, misleading, or fraudulent information including payment or order details
Harass, threaten, or harm NurseWear staff or other customers
Reproduce or resell NurseWear products or designs without written authorization

NurseWear reserves the right to terminate access to the Site for any user who violates these terms.

10. Disclaimers

NurseWear provides the Site and its products on an "as is" and "as available" basis without warranties of any kind, either express or implied. NurseWear does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

NurseWear apparel is intended for casual and lifestyle use only. NurseWear products are not medical uniforms, personal protective equipment, or endorsed by any medical or nursing authority.

11. Limitation of Liability

To the fullest extent permitted by law, NurseWear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products. NurseWear's total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid for the order in question.

12. Third-Party Services

NurseWear uses third-party services including but not limited to print-on-demand fulfillment providers, payment processors, and shipping carriers. These third parties have their own terms of service and privacy policies. NurseWear is not responsible for the actions, errors, or omissions of any third-party service provider.

Links to third-party websites may appear on the Site. These links are provided for convenience only. NurseWear does not endorse and is not responsible for the content or practices of any linked third-party site.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site you consent to the collection and use of your information as described in our Privacy Policy.

14. Changes to These Terms

NurseWear reserves the right to update or modify these Terms at any time without prior notice. Changes will be posted on this page with a revised effective date. These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Pennsylvania.
